Lennar on Defective Brick Pavers – We’ll Fix Them – Just Not Yours

One of the first issues I had with my new construction home by Lennar at 6111 Yeats Manor was the pavers. As you’ll read, I’m clearly not alone with my issues of defective brick pavers.

As soon as I drove up to meet Bob Harrower at my new construction home before closing, I immediately noticed something wrong – the brick pavers were sinking. The pavers were an issue since before I closed on the Lennar home in May of 2013 at the Westshore Yacht Club. They continue to be an issue.

I immediately noticed the sinking – this is in May of 2013 just days before closing on a new construction home by Lennar at 6111 Yeats Manor Drive in the Westshore Yacht Club neighborhood.

Besides the pavers sinking, I continued to find issues with cement left on them, as well as discoloration. WCI Communities (now Lennar) came out on several occasions to fix the pavers. Joel Fedora even suggested I seal the pavers in an attempt to reduce the risk of continued discoloration. Unfortunately, I trusted him.

I sealed the pavers – we all did

Within the first couple of months, I sealed my pavers. Many of the homeowners followed after me in also sealing and shining their pavers. It seemed to work. These are pictures of my pavers in the first months after sealing them.

Over time, this is what my pavers started to look like by the spring and summer of 2015. This has nothing to do with the seal, as neighbors who didn’t seal have the same paver issues.

This is the exact step I’m sitting on in the picture above at 6111 Yeats Manor Dr in Tampa, FL. Defective pavers that are discolored at a new construction Lennar home. Even those that did not seal their pavers are having the same issues that can’t seem to be fixed.

The paver defects not only include discoloration but loose or sinking pavers as well.

Lennar claims I voided the home warranty

On the exact day – July 25, 2015 – that Lennar tells my attorney that it’s my fault for sealing (even though Joel Fedora of Lennar indicated I should) and that I voided my Lennar home warranty, Lennar is at my neighbor’s house attempting to yet again repair their pavers. The kicker? They also had their pavers sealed. Here are the pictures I took on that day when Lennar was fixing the same issue that they refused to fix for me.

Not surprisingly, the multiple attempts with Lennar to repair or replace my neighbor’s defective pavers did not work. They still look like mine.

As I continued to do my research over the years, I found lots of complaints of defective brick pavers in Lennar neighborhoods. Many of my neighbors at the Westshore Yacht Club have had – and continue to have – the same paver issues. Here are some samples from Facebook alone.

Here is the history on this issue that’s gone on for 4.5 years.

Here’s the summary from all of the construction issues I keep in a spreadsheet.

*Note: For simplicity, the Lennar and WCI Communities names here are used interchangeably as Lennar took over WCI in February of 2017.

The first deals with the issue of the discolored defective pavers.

Pavers – Mr. Fannin’s pavers are becoming washed out and almost white in color. Joel Fedora and Bob with WCI previously informed Mr. Fannin that by sealing his pavers, he voided the warranty. However, it was recently discovered that WCI is repairing the pavers of Mr. Fannin’s neighbors who also sealed their pavers. This is not the first time that Mr. Fannin notified WCI about paver problems. Mr. Fannin first notified Bob at WCI regarding the sinking of the pavers on the extended lanai on May 12, 2013.

None – this issue was noted after the construction issues went to legal.

Per 6-30-15 letter from WCI counsel, WCI performed repairs on the pavers. After those repairs, Mr. Fannin sealed the pavers, which voided the warranty.

WCI repaired neighbor’s after seal – WCI did not provide seal or apply it to the pavers. I am assuming you are referencing WCI/Lennar as ‘the Company’
