Five days after sending an email to Lennar’s C-level executives, they provide an unbelievable response – a legal letter. This prompted me to develop this website.
I heard nothing from Mark Metheny after sending numerous communications, including a call after my 20th A/C malfunction. Since it had been more than two months since I heard from Mark in an email in which he promised to “followup [sic] on below asap,” I decided to send an email to the Lennar C-level executives, including CEO Stuart Miller.
My mother has been trying to get ahold of someone from @Lennar for 3 days now to have them come fix the cabinets they clearly didn’t install correctly in her brand new townhouse. This response prompted me to build this site
The only opinion I am going to put around this is that it’s incredibly inaccurate, which means it’s completely confusing, and it’s a bully tactic. That’s what Lennar does. That’s obviously about what their corporate culture thrives. Lennar tries to make things as confusing and difficult as possible so you just give up, and when you don’t give up, they resort to bullying. Remember, this is coming from the top-layers of Lennar, including the CEO.
Just look at how their responses to more than 80 Lennar construction defects change repeatedly. It’s confusing – and incredibly frustrating. I’ve now learned that’s the point.
I’d still love to give these people the benefit of the doubt as it’s clear they have either not enough information and/or inaccurate information. However, this response – and the manner in which it was done – tells me it’s just who they are as people – and a company.
This letter, and the next few completely confusing communications I have with Lennar and specifically Jim Yeadon, are the primary reasons I am putting this site together and filling it with as many of the relevant communications as possible. I never want to explain the last 4.5 years again, and I am certainly not going to let who is soon-to-be the largest builder in the nation continue to confuse and bully people.
So at the end of this post, I’ll put the relevant links to other communications and items to give you an idea of why I was so confused.

Here is the response from Lennar’s CEO and executive leadership team
On August 10, 2017 – five days after sending my email – I receive an email from Lennar’s legal department. It simply said:
Please see attached correspondence. Thank you.
There was a PDF attached to the email.
Here is what was in the PDF (a few items redacted and I’ll add relevant links to posts and articles here for context and that weren’t included in the original communication):
Dear Mr. Fannin:
We are in receipt of your email to Lennar’s executive team and disagree with your statements and allegations contained therein.
As you know, Lennar is under no obligation to perform repairs to your home. Notwithstanding our lack of obligation, Lennar offered to address many of the items you have raised as a concern. Also, as a courtesy, we offered to have an environmental consultant evaluate your home. We have attempted to work with you but you are unwilling to work with us.
Throughout this process you have made it clear that you are only willing to accept Lennar’s purchase of your home as a settlement of your alleged claims. As previously discussed, Lennar has no intention of purchasing your home. We are still willing to assist you and finalize the Work Authorization and Release concerning the work we are willing to perform. Alternatively, Lennar is willing to perform the repairs to the A/C system without requiring a release. Please contact Jim Yeadon, Director of Customer Relations, at [redacted] or via email [redacted] on or before August 31, 2017, to schedule a mutually convenient time for this appointment.
Please be advised that this letter contains settlement negotiations, and as such, it is not intended nor should it be construed to be admissible in any proceeding. We look forward to concluding this matter.

The letter was also sent via FedEx and it arrived the same day.

Relevant items to address this response
One of the purposes of this website is to make it an archive of everything relevant to the last 4.5 years since I built a new construction home. Check back as I’m sure I’ll add more information to this post. As of now, here are the key items that contradict this letter and make it confusing to me.
- WCI (Now Lennar Homes) Lied in Their Legal Response. Why?
- Although I told Mark Metheny that I wanted out of the house and said ideally to make a buyout, that was not by far the only solution. Read: I Answer Mark Metheny’s Question – “How Can We Make This Right?”
- As you can see, Mark Metheny and his team (Jim Yeadon, Steve Smith, and Rick Hudak) just stopped communicating. There was still a lot that was not inspected and there was a lot of confusion over some of the construction defect items. - Even in my last attempt to contact them, I indicated:
In the interim, is there a way to determine how many additional inspections there will be an how much time they will take? I know you all are trying, but please remember I’ve been going through this for four years and it’s greatly disrupted my life and work.

Can we please try and find a way to resolve all of this as fairly, quickly and while minimizing ongoing disruption as possible?
Read: Email to Lennar: “I Simply Want My Life Back. All I Wanted Was a Home.” I never heard back from them. Sure they offered the environmental inspection, but they never responded back to any of my communications.
After you read some of those posts, you’ll realize why I was confused and had no idea what they expected me to do when so much had not yet been discussed or decided with the Lennar executives I had been working with for over 3 months.

Note: As of the date of this publication, all the Lennar executives went silent and none of the construction repairs were ever made, including the promised replacements of two, improperly installed and defective A/C units causing extensive mold exposure and health issues.
